Update from Emily Levy:

Election challenge case update: I just spoke with John Roberts Brakey. The judge will be issuing his final ruling tomorrow morning at 8:00 a.m. to the parties (including us) and at 8:30 to the media.

After we rested our case, as is typical the defense moved for summary judgment. This means they asked the judge to rule on the case in their favor before even presenting a defense. Summary judgment was granted for Pima and Santa Cruz counties but NOT for Maricopa County. As I understand it, this was because our evidence of serious problems with Pima and Santa Cruz Counties’ election processes AUDIT-AZ has documented in past elections wasn’t enough evidence to throw out this year’s election.

Much good has already come from this case, thanks to very hard work by John Brakey, our attorney Michael Kielsky, and the entire AUDIT-AZ team, plus everyone who has been supporting us in ways large and small. We await Judge Gass’ ruling in the morning. We’ll have more to say then.
